Beijing issued “the notice on the implementation of the informing and commitment system for foreigners’ non-criminal certificate”
Recently, aimed to implement the national decision of "simplify certificates and facilitate the people", the competent authorities of the Beijing Municipal Government has issued a notice on the implementation of the informing and commitment system for foreigners’ non-criminal certificate for those who is coming to work in China, in accordance with relevant demands on the Implementation Plan for the Comprehensive carrying out the notice of informing and commitment system for certificates and the promotion of optimizing the business environments.
The “Informing and Commitment System” is applicable to the below:
The Beijing employer can decide freely whether to replace the non-criminal certificate with the “Informing and Commitment system” or not.
If the employer is unwilling or unable to make a promise, then a standard non-criminal certificate would be still required from the applicant
Foreigners to work in China and the employers without any serious bad credit record or have not made false promises can make a commitment;
Foreigners to work in China have no criminal record in their home country or abroad.
The contents should be written on the commitment are as follows:
Ensure the required documents submitted are true, legal, valid and complete;
The foreigners to be employed have no criminal record in their home country or abroad. The employer has no serious bad credit record or any history of making false promises, etc;
With willingness to take the legal responsibility or other punishments related to the informing and commitment notice if they promise any false information.
Procedure of the implementation on the “informing and commitment system”
The employer should carefully fill in the "Commitment letter of the informing and commitment system" and affix with the official seal to validate it, after reading the "informing to the employer providing the certificate".
When applying for work permits for foreigners, the above Commitment Letter would be a replacement of the con-criminal Certificate for the online approval and on-site acceptance. If the competent authority considers that the conditions are met, the applicant is no need to submit the Certificate of non-criminal records. If the conditions are not met, then the general procedure would be required for the employer.
The competent authority will supervise and check the condition, when necessary, it will request the employer to provide additional certificates of non criminal record by a deadline. Those found to have made false commitments will be punished by law and listed in the credit record. Those suspected as a crime will be reported to the judicial authorities by law.
